The Research Of The Crime Of Illegal Fund Raising Under The Background Of Internet Finance

This thesis is intended to study how to balance the regulation between financial innovation and the traditional criminal law,which mainly focus on three issues.Firstly,the characteristic of criminal law from the perspective of Internet finance,namely,the principle and attitude of criminal law in dealing with Internet financial crime.Secondly,the business behaviors of P2P,such as the scope of subject,business model,management,and business forms are legal or illegal.Finally,how to distinguish P2P and illegal found raising crimes from the perspective of the internet finance.This paper hope to draw useful conclusion by studying the internet finance and experience from abroad.On the background of internet finance,the illegal found raising crimes become more and more complicated.Through the analysis of its characters from principle and attitude of criminal law,we can handle illegal found raising crimes more efficiently.
