Research On The Legal Status Of Traffic Wardens

The police assistant system in mainland China came into being in the 1970 s,and the traffic warden system began with the first traffic warden team set up in Kunming,Yunnan Province in 1984.Traffic warden is an auxiliary public security force to assist the traffic police to perform public functions,carrying out their work under the command and supervision of the traffic police.Due to the lack of relevant theoretical research and legal provisions,traffic wardens are controversial in practice.Therefore,this article will start with the development and changes of the traffic warden in our country,through the study and reference of the extraterritorial auxiliary police system,analyze and discusses its legal status,work duty,rights and duties,and finally put forward the suggestion of legalization and the standardization development.This paper is divided into the following parts:The introduction first puts forward the issue that the public has a dispute on the authority of traffic wardens,and expounds the relevant literature,research methods and significance.The first part analyzes the development and present situation of the traffic warden system in mainland China,compares and analyzes the extra-territorial auxiliary police system and its enlightenment.The second part of this article separately elaborates the administrative authorization,the administrative entrustment and the administrative assistant connotation and makes the distinction,then discusses and analyzes the traffic warden's legal status from three angles : the academic theory,the practice,the regulation.In the third part,the duties are summarized into three categories: order management,propaganda service,and administrative punishment.At the same time,the paper clarifies that the traffic warden who is in the position of administrative assistant has no administrative punishment power.The fourth part focuses on the rights and obligations of traffic wardens according to the rights and obligations of traffic police.The fifth part suggests that the traffic warden system should take the road of legalization and standardization,and change the current deficiencies in legal protection,organization and management and occupational security.
