In recent years,with the improvement of people's living standards and the awareness of rights,patients' right to informed consent has received more and more attention.In medical practice,doctors often have conflicts with the patient and their family members' right to know and consent in order to rescue critically ill patients.The resulting medical disputes are not uncommon.Under such circumstances,how to balance the right of informed consent of patients and their families and the emergency treatment of doctors has become an important issue that cannot be avoided before us.In this study,we selected two typical typical cases of Xiao Zhijun and Yulin Maternity in recent years,and found that the right of informed consent of patients will be decided with the family's medical decision in the case of emergency assistance.The right of special intervention in hospitals has conflicts of rights,which seriously affects the emergency treatment of doctors,which prevents patients from receiving timely treatment,which ultimately leads to the loss of patients' right to life and health and the loss of precious lives.Article 18 of the Judicial Interpretation of Medical Damage Responsibility has repaired and perfected the system of informed consent under the emergency treatment,but in practice,there are still many problems that cannot be solved,such as the issue of the rights of close relatives,close relatives Whether the internal contradictions must be decided by the doctor and when the close relatives are obviously unfavorable to the patient's life and health.In this regard,put forward corresponding suggestions for improvement,in order to better solve the problem of informed consent under the emergency treatment.
