Criminal Law Regulation Of Information Crime

Information crime refers to the criminal act of using information as the object of crime,the information herein mainly includes six categories: state secret information,intellectual property information,citizens' personal information,computer information,financial information and illegal information.In the crimes which citizens' personal information is the object of crime,there is a problem of determining the nature of collecting and sorting out citizens' personal information for commercial purposes.To solve this problem,we should add the crime of illegally holding personal information of citizens through the amendment of criminal law,any natural person or legal person holding citizens' personal information for more than 5000 pieces without reasonable explanation shall be convicted to have committed the crime of illegally holding citizens' personal information.In the crime of using computer information as the crime object,determining the nature of providing the public security vehicle information service through network group is a conundrum,such behavior,through the judicial interpretation,shall be recognized as crime of illegal business operations.In the crime using criminal information as object,the nature of virtual property is still controversial,in order to meet the legislators' purpose of setting up the crime of illegal acquisition of computer information system data,virtual property should be identified as electronic data information.
