Research On The Perfection Of Medical Technology Patent Pool In China

Today,with the AIDS epidemic and the high prices of patented drugs,the development of the medical technology patent pool has become an urgent need to improve the health and medicine industry of China.In order to clarify and accelerate the development of China's medical technology patent pool,it is necessary to study some problems which are needed in order to perfect China's medical technology patent pool.In this paper,some problems existing in China's medical technology patent pool are studied through interdisciplinary research method,extra-domain analysis method and case study method.It is found that there are three kinds of problems: Firstly,the construction method has limitations,besides,excessive government intervention during its development,finally,there is not enough attention to generic drugs.These problems have hindered China's medical technology patent pool from providing public health and well-being to the society and accelerating the development of the medical industry.In order to solve these problems,this paper analyzes the necessity and feasibility of solving above problems through jurisprudence and law and economics,and also seeking the applicable path of China through the study of the extraterritorial medical technology patent pool.On this basis,the guidance of disease and drug is put forward as the construction dimension,multi-regional cooperation as the construction direction of China's medical technology patent pool,and the guidance role of government to lead the impact of enterprises and markets as well as paying attention to seek for international cooperation in the development of generic drugs.Based on the complexity and particularity during development,we would improve the existing problems of China's medical technology patent pool,so as to achieve the goal of balancing and the medical technology patents in social and economic benefits,and achieve its long-term development.
