Research On Exclusion Of Repeated Confession In Criminal Procedure

Illegal interrogation,confession complex and file transcript centralism and so on factors caused or contributed to the problem of "repeated confession".There are two kinds of obstacles,before excluding "repeated confession" : one is careful consideration of all related factors,such as different interrogation personnel,different time interval,different severities,different body and mind of suspects;the other is unfavourable judicial condition,such as self-protection of investigation organ,proving mode of "confirm each other",prosecution claims precedence and so on.In addition,the defenses` claim of "pre-trial confession illegally obtained" are rarely realized.Combined with the external exclusion rules and domestic legislative propositions,this paper`s proposal is Optimizing the judicial environment,Making up for legislative defects,Improving the quality of justice.
