In recent years,China's economy is developing at an unprecedented speed,especially the development of logistics industry.General secretary xi has continued to strengthen the rule of law,and the whole society has significantly improved its concept of the rule of law.China has issued and implemented the decision on punishing crimes violating the company law,which provides a comprehensive and complete explanation for the crime of embezzlement by position,and classifies the crime of embezzlement by position into property crimes,with the main purpose of cracking down on the ACTS infringing upon the ownership of enterprises,companies or other property.The earliest legislation to define the crime of embezzlement as an independent charge and stipulate an independent statutory punishment was the great refreshing criminal law,which was also included in the criminal law of the republic of China later.After the founding of new China,the criminal law of our country stipulates the object of the crime of embezzlement.This paper mainly discusses the embezzlement of other people's property.Larceny is a common crime in daily life,with the highest incidence rate.Its occurrence has a serious impact on the stability of people's life and has a strong social harm.The crime of larceny,the crime of embezzlement and the crime of embezzlement are very similar.In judicial practice,even if it is the same act,the judicial organ and case handling personnel often have different conclusions due to their different understanding of the objective aspects of the constitutive elements of the same act.There is a big dispute over whether the act constitutes a crime andwhat crime to determine,which will often lead to different processing results.Based on this situation,this paper intends to make a detailed analysis of the basic principles of the criminal law of the three crimes,combined with case analysis,to define the similarities and differences of the three crimes.
