The Research On The Reasonable Protection Of Personal Information&Privacy In Big Data Era

In the era of big data,individuals have less control over their information and personal information makes it easier to identify individuals.Big data brings about technological changes while threatening privacy.The development of personal information and privacy protection laws has become a major measure for the Chinese government to build an information society and promote the healthy development of big data industry.The first chapter briefly explains the concept and highlights the technology to excavate the huge value of big data.The era of big data is the background and starting point of the study of personal information protection in this paper.The hierarchical classification of personal information is for protection.Personal information does not equal privacy.Therefore,privacy cannot provide comprehensive protection for personal information.Secondly,the purpose of personal information protection is to protect people's dignity and personal interests of information resources.People's "digital survival" will affect people's autonomy and dignity,and the law can be reduced to this effect.There are four doctrines of the legal nature of personal information,and the protection of personal information cannot rise to the right of personal information.Personal information protection starts with privacy,not just privacy.Through the decomposition of the bundle of personal information rights,personal information rights include access rights,correction rights,and deletion rights.Once again,through the comparison of the protection system for personal information between the United States,Europe and Japan,it was discovered that the protection of personal information in the United States is based on departmental legislation and industry self-regulation,with more emphasis on the normal use of personal information,and the EU's protection of individual rights is more stringent.The US model is worth our country's reference.Finally,through the balance of the free flow of personal information,economic development and protection of personal information,the path of rational protection of personal information in China is improved: technical norms,industry self-regulation and legislation,and remedy.
