The Research Of System Of Disregard Of Corporate Personality From The Perspective Of Separation Of Trial And Enforcement

In November 7,2016,the Supreme People's Court issued "the Supreme People's Court on civil execution in change,additional parties the provisions of a number of issues",aiming at guiding the correct handling of related problems during the execution of the change or addition of the parties,effectively safeguard the party's interest in favor of increasing,to solve the problem of "the difficulty of the civil execution".However,the provisions on the implementation of the program in the establishment of a legal person personality deny rules to some extent from the challenges in the implementation of practice we always adhere to the "independence" separation principle.The author attempts from the perspective of separation of trial and enforcement using the substantive law and procedural law to analyse the provisions of the system of disregard of corporate personality similarities as well as the theoretical circles on the analysis should be applicable in the procedure of execution of simple introduced the development and status quo of China's “the separation of trial and enforcement”,finally pointed out that in the process of civil execution of the corresponding direct application of disadvantages of the system of disregard of corporate personality,and puts forward some personal suggestions.
