The Determination And Exercise Of The Right Of Property-right Commercial Shops

After more than ten years of exploration,China's real estate industry has become an important development power of China's national economy.But at the same time,the commodity housing market competition is increasingly fierce.In order to seek a better development model,reduce investment risk and recover the costs far as possible,the business model of property-right commercial real estate is developed in China gradually and is used in the urban development a lot.“Property-right commercial shop” is the most common form among property-right commercial real estate.Because of the short development time of this pattern in our country and the lack of the relevant laws and regulations,it appears many different results of the same cases in judicial practice.Therefore,in this paper,the author hopes generalize the focus of controversy and clarify the type of property-right commercial shops through a comparative analysis of the case.The author also hopes to put forward the relevant dispute settlement to promote the perfection of our legal framework,in order to better balance the interests of every party of property-right commercial shop relationships,and maintain the healthy development of the domestic real estate industry.
