Research On The System Of Civil Execution Reconciliation

Since the system of civil execution reconciliation is conducive to the timely realization of human rights,it is widely used in judicial practice.The parties change the payment amount,the manner or the deadlines of the legal instruments have determined to make it more fit in the actual situation of the parties.The system makes the rights achievement of human rights timely,and it helps promote understanding between the parties.The first chapter is based on the definition of previous scholars put forward their own point of view,and analyzes the court to review the role of the settlement agreement,the emphasis on the importance of the principle of party autonomy in the execution reconciliation system.The second chapter is the analysis the relationship between the execution reconciliation and reconciliation,civil mediation.It describes the particularity of system of civil execution reconciliation.Meanwhile,It explores the nature of the execution reconciliation agreement.The third chapter is the analysis of the effectiveness of the civil execution reconciliation.The author analyze two parts In this chapter.Firstly,the author introduce the effectiveness of the settlement agreement during execution reconciliation.Secondly,the author introduce The remedies for the parties to the execution of the settlement agreement under the current legal framework in China,and explore two problems.The last chapter is the problems and countermeasures in the judicial practice of fraud.Since the implementation of the settlement system in practice a lot of controversy,the author only choose two questions.
