Since 2006,P2P(Peer-to-Peer Lending)service has been surging up on a global scale.The essence of the development of P2 P platforms is the combination of modern Internet technology with current social capital loan demand which achieves the flow and matching of debit and credit information,meets the borrowing demands,and promotes the development of current Internet banking based on a series of features including the wide influence range,high efficiency,etc.of the Internet.Renren Dai,As China’s first P2 P platform,has used the development mode of those platforms in Britain and America for reference,and makes information collection,gathering and matching for the public as a simple information intermediary.But in China’s traditional native P2 P lending mode,the platform’s role as a simple information intermediary can not meet the requirements posed by lack of social credit system,lack of risk awareness,improper thinking like expectation of ‘rigid payment’,etc.,which brought certain difficulty for the development of network debit and credit.Although P2 P platforms intend to enhance investors’ confidence,attract investment in the form of providing a guarantee,and achieve the purpose to promote borrowing transactions,it is easily observed that potential risks emerge in almost all types of guarantee modes.This paper aims to analyze the main operation modes and potential legal risks of different guarantee modes through their typical issues during P2 P lending,and put forward specific advice to the regulatory supervision of guarantee modes and gradually promote the process of ‘getting rid of guarantee’ for P2 P lending industry on the basis of avoid ‘imposing uniformity in all cases’ for guarantee.
