Research On The Evolution Of Intellectual Property Policy Based On The Policy Tools

China has been moving toward a powerful country for intellectual property after the 30 s years arduous development in the wind and rain.However,there are still many questions about chinese intellectual property,such as the intellectual property is large but weak,and multiple but not superior,at the same time there are the imperfect system and inadequate management.Therefore,at the end of 2015,the State Council promulgated Document No.71,which clearly stated that “the realization of the intellectual property governance system and the modernization of governance capacity by 2020” will open a new goal of building a strong intellectual property county.It can be seen that China's intellectual property industry is facing new situations,new developments and new requirements,and is transforming from a large intellectual property country to a strong intellectual property country.However it the high time to investigate the evolvement of intellectual property policies in China.At the time when the State Intellectual Property Office carried out the Tenth Anniversary Evaluation Project for the implementation of the Outline,this paper also evaluates the efficiency of China's intellectual property investment and related factors.The historical intellectual property policy database contains the relevant laws,regulations,guidance and another policies that released by the government.The bibliometrics of policy database could be used to evolution characteristics of intellectual property in China based on the policy tools.Using the stochastic frontier analysis model,the efficiency of intellectual property investment was analyzed based on the panel data of 10 years from 2007 to 2016.By adopting Cobb-Douglas production function,the model for investment efficiency and production factors of intellectual property were discussed.The technical inefficiency equation was established to analyze the policy factors.Further the analysis demonstrate that evolution of Chinese intellectual property policies has five stages composed of constructing laws,serving science and technology,internationalizing,strategizing and promoting national power.Moreover,the application and integration of policy tools changed constantly along with the transformation of policy targets,especially the fundamental policy tools are switching from the creation and protection to the utilization and industrialization of the intellectual property.The results also show that for the intellectual property undertakinginvestment efficiency,the policy tools of creation and application have positive effects,and the policy tools of protection and management have positive effects.
