The Establishment And Application Of Big Data In China's Judicial Field

Big data technology has been developing rapidly in China in recent years.It is a new data processing system derived from Internet technology,Internet of things and electronic technology,and with the continuous development of Internet technology,Big data's application scope and function also gradually expanded.Big data technology can deal with a large number of data which can not be processed accurately and quickly by traditional tools.At present,big data technology refers to the use of massive data sets,computer algorithms,data mining,analysis and application to obtain the value of data.With the continuous improvement of the degree of information in society,the judicial or personal data information that can be collected is increasing,the amount of data information is huge,the content is accurate,and the function and value of the judicial system is inestimable.In this paper,the author will discuss the establishment method of judicial big data system and its application in the judicial field from five aspects,find out the existing problems,and give the corresponding perfect measures and schemes.In the first part,by introducing big data's concept and characteristics,on the basis of analyzing several theories that existed before,the author gave the concept of judicial big data.And through the analysis of the connotation and extension of the concept,this paper expounds the characteristics of big data,as well as the characteristics of big data at the level ofthinking through the analysis of the characteristics of the concept.It lays a foundation for the application of judicial big data on the level of thinking mode and methodology.In the second part of the article,combined with the analysis and summary of big data's concept and characteristics,the author gives some methods and suggestions for the establishment of judicial big data system.The construction of judicial big data system in our country should be based on the full disclosure of data,build up the technical system of judicial big data system,train relevant talents,and establish a high-quality judicial statistics and analysis team.To clear the way for the establishment of judicial big data system.In the third part,the author discusses big data's applicable field.By analyzing big data's possible role in case management,case investigation and case execution,the practical value of big data in the judicial field is demonstrated.Then in the fourth part,the author starts from big data's current application in the judicial field,and analyzes the problems existing in the current application process of big data,including the absence of personal information protection law,the imperfection of the third party's industry norms.And in the course of big data collection of data accuracy can not be guaranteed and so on.On this basis,this paper analyzes the reasons for the above problems,such as the contradiction between personal information protection and personal information utilization,the untimely access speed of adjudicative documents and the unclear division of labor among various departments within the court system.In the last part of the article,the author explores the problems and causes in the establishment and application of big data in the judicial field,and puts forward his own methods to solve the problems and perfect measures.Through the construction of the right system and procedure system of personal information protection,the establishment of the legal norms of the third party industry,the perfection of the management limits and the clear division of responsibilities from the inside of the judicial system,etc.For the current judicial big data system and the establishment and application of practical solutions and ideas.
