Research On The Legal Nature Of Imposed Disposition

With the rapid development of modern science and technology and economy,interest-oriented thinking is becoming more and more active,to make some people willing to engage in fraudulent transactions at the risk of breaking the law,the lag defect of law as statutory law is becoming more and more serious.This article attempts to study the act of impersonation,the typical situation is as follows:The perpetrator faked the real right person by certain means.At the same time,this behavior "cheated" the bona fide counterpart and the real estate registration authority so that the corresponding rights in the real estate registration were registered in the name of the bona fide counterpart.Of course,there is the behavior of disposal of movable property by impersonation in practice,Such as impersonation of credit card and equity,etc.But this paper only chooses more typical types of disposal of immovable property.There are different solutions to the above-mentioned problems in judicial practice.And the academic circle also has the corresponding academic argument.Most of the conclusions are still within the scope of application of bona fide acquisition of immovable property and application of agency system.But obviously,the research perspectives of scholars have begun to shift to the discussion of the impersonation itself.Therefore,the purpose of this paper is to solve the legal nature of impersonation.This paper intends to solve the problem of the application of impersonation through case analysis and the investigation of relevant theories at domestic and foreign.
