Financial Institutions Participate In The Research On Legal Issues Of PPP Projects By Means Of Equity Investment

Since it was first put forward in his government work report in 2014 to encourage non-state capital into the financial,energy,utilities and other fields,local governments at all levels to promote the PPP projects,will produce large capital requirements,scheduling ability,money has a strong financial institutions involved in PPP projects become inevitable trend.In practice,financial institutions participate in PPP projects in the form of equity investment,and as financial investors,they are not eligible for admission.The lack of investment capacity is questioned as a social capital.China's financial institutions involved in the successful experience of the PPP project in equity investments way is not yet complete,in the "enter",the project company's operations,there exist many problems,"exit" to the above problems from the legal system made perfect,clear the financial institutions involved in the PPP project legal obstacles,make financial institutions actively involved in the PPP project investment,in order to solve the PPP project investment and financing problems.This paper starts from the legal problems of the participation of financial institutions in PPP projects by means of equity investment,and is divided into five parts.The first part of the paper two methods of financial institutions to participate in the PPP project,analysis of the financial institutions involved in the PPP project in equity investment way of typical cases,to review and summarize financial institutions involved in the PPP project in equity investment way legal policy environment.In the second part,through analyzing the market access of PPP project,this paper probes into the admittance of social capital,and then discusses the market access of financial institutions in PPP projects.In the third part,the author analyzes the control problem of PPP project company,and then discusses the control problem of the PPP project.The fourth part analyzes the social capital withdrawal mechanism of PPP projects,and then discusses the withdrawal mechanism of financial institutions participating in PPP projects.In the fifth part,the author puts forward some Suggestions on the participation of financial institutions in PPP projects,from the aspects of admittance system,corporate control and withdrawal mechanism.
