Under the background of the shortage of energy resources in China,overseas energy investment is the safest form compared with various forms of energy cooperation.Therefore,finding overseas resource represents profound significance.Energy as a core factor related to national security,due to historical reasons,developed countries have before the developing countries to seize the relatively good energy investment environment in the region,China's enterprises can play a lot of space confined to the legal environment is not very sound in developing countries,So,involving energy investment in Central Asia,Chinese enterprises face larger legal risk.Energy investment itself,the characteristics of large investment,long recovery time,doomed to energy investment is a high-risk industry,in order to improve the safety of Chinese enterprises on energy investment in Central Asia,from a legal point of view,especially from the perspective of international law on the in-depth understanding of energy investment risks and thus put forward preventive countermeasures.This paper first introduces the historical background of energy investment between Chinese enterprises and Central Asia,and analyzes the risks encountered by Chinese enterprises in energy investment in Central Asia.Secondly,it expounds the relevant regulations,preferential policies and dispute settlement measures of the Central Asian countries external energy investment.Thirdly,Through the domestic rule of law and international treaties that introducing energy investment legal risk and precautionary measure,get inspiration to improve the mechanism of China.Finally,from theenergy legal system and the construction of specialized energy legal institutions and other aspects of the Chinese enterprises on the Central Asian Energy investment legal system to improve the recommendations.only a sound legal regime for energy investment and dispute resolution can effectively mitigate and respond to the risks faced by Chinese enterprises for energy investment in Central Asia and foreign energy investment,and for Chinese enterprises,it is necessary to fully understand the relevant systems of investment in the host country and China on energy investment,and to use the treaties signed by our country with the Central Asian countries to protect themselves against the risks in energy investment,and for the government to encourage Chinese enterprises to invest in energy in Central Asia,We have stepped up efforts to create a favorable external environment for Chinese enterprises to invest in energy in Central Asia. |
