It's already past 40 years Since the birth of the Internet.The Internet industry has developed rapidly with the increasing popularity of the Internet.Especially for nearly a decade,China's Internet economic development more faster than the real economy.The rapid development of the Internet economy lies in the innovation of science and technology.Because there is competition between enterprises,than the "friction" naturally inevitable.There is kinds of competition behavior between Internet companies are complicated,for example,Set the insert,Tamper acquiescent Shielding online advertising and so on.Some behavior is in order to hijack traffic from other Internet operators,some behavior is for "free rider",the use of the other's popularity to obtain the benefits.No matter what they do,they purpose is to enhance their own market competitiveness,access to more market resources,or weaken the strength of competitors.And how to identify the nature of these acts.The article use Sogou v.Chiger unfair competition as an example.Analyze whether traffic-hijack is unfair competition.The first chapter of the article is the case,then Put forward three questions.The second chapter is the first question,how to determine the competitive relationship between the actor and the victim in the case of traffic-hijack.The third chapter analyzes the nature of the act of traffic-hijack.In thelast chapter,we discuss the definition of technological innovation and unfair competition in the case of Qihoo's argue and refute.At the end of the article,it's mainly identify the nature of traffic hijacking and the conclusion of the whole paper.
