A Study On The Expert Opinion In The Civil Procedure

Forensic opinion as an important form of evidence in the civil litigation practice,plays an increasingly important role in the judicial practice,but with the social reasons of the judicial authentication institutions,the imperfection of the matching management system,the current judicial expert opinion credibility is facing challenges.If the standard appraisal institutions can not very well make the expert opinion of the whole process not accurate on the expert opinion certification review,it will reduce the efficiency of litigation,damages the legitimate rights and interests of the parties,or even seriously affect the judicial justice.This article from the Qingpu court of traffic accident cases using expert opinion analysis,the existing problems in the practice of civil judicialexpertise starting with summary of expert opinion,analysis the theoretical basis and legal practice,analyzes existing problems from the causes,and then according to the expert opinion of justice in civil litigation problems This paper puts forward some suggestions,which can better serve the litigation activities,better protect the legitimate rights and interests of the parties,so as to better solve the social disputes and safeguard judicial justice.This paper is divided into four parts,the first part mainly analyse the current situation of the use of expert opinion in the court of Qingpu traffic accident cases were,found that the civil judicial identification problems,mainly reflected in the starting process,the review process and the problems in the process of application.The second part starts from the overview of judicial expert opinion,the analysis of the theoretical basis and legal principle.The third part is combined with the principle analysis of the cause of the problem in judicial appraisal.The fourth part from the perspective of solving problems,in view of the current civil litigation judicial appraisal opinions of existing problems and put forward suggestions.
