Research On The Prevention And Control Of Domestic Violence Crimes

Domestic violence crime,in essence,is a violation of the personal rights and interests of family members,and it is a kind of relentless trampling on human rights.As a crime that occurs among family members,the crime of domestic violence dose not only cause the victim's physical,mental,and spiritual damage,but also destroy family relations and social civilization in different degrees.Moreover,many victims of domestic violence are devastated by domestic violence and it is difficult for them to face their psychological and spiritual shadows.They even take a road of “violence against violence” which causes vicious criminal acts and bad social impact.In order to better prevent and control crime,China has promulgated several policy measures at the institutional and practical levels in an effort to effectively regulate domestic violence.Although the implementation of various initiatives has achieved certain results,it has not achieved the expected social effects.In particular,in recent years,the problems caused by domestic violence in China have emerged in an endless stream,and the serious state of domestic violence crimes has not yet become better.Two years after the enact of the Anti-Domestic Violence Act,the author selected 141 cases of typical domestic violence crimes in China in the past two years,together with relevant nationalpolicies as the example of this article.Through the analysis of relateddata,the author summarizes the general characteristics of domestic violence crimes,and summe up the causes of the crimes.Thus,the authordesign the path of prevention and control of domestic violence crimes that is actually in line with China's actual situation.The article begins with the introduction.The full text is divided into three parts.The 141 cases of typical domestic violence crimes occurred in the past two years and were taken as objects.The paper is written according to concepts—phenomenon analysis—cause analysis—path design.The first chapter is a summary of domestic violence crime and analysis of the status quo of domestic violence crime.The first section defines the concepts of domestic violence and domestic violencecrime.The interpretation of the concept of domestic violence is based on the relevant regulations of each country.At the same time,the concept of crimes of domestic violence is defined in conjunction with the concept of crimes in criminology and criminal law;in the second section,domestic violence crimes and related behaviors are analyzed and the connection between domestic violence crimes and related behaviors are summarized.Finally,through the discrimination of domestic violence crime and other related behaviors,the relation and difference between domestic violent crime and other related behaviors are clarified.The third section analyzes the current situation of 141 domestic violence crimes.From the aspects of the types of domestic violence crime involved,the circumstances of sentencing,the characteristics of the subject of the crime,the relationship with the victim,the area in which the crime was involved,and the province,they were summed up to form a summary of the characteristics of the 141 research samples.The second chapter is based on the analysis of the first chapter,combined with relevant data analysis and crime characteristics,and summarizes the causes of domestic violence crimes.Based on China's current ideas,systems,and laws,we analyze the three aspects of subject characteristics,social environment,and Judicial intervention.The third chapter is based on the second chapter,combined with relevant data and crime characteristics.The author summarizes the causes of domesticviolence crimes.Based on China's existing concepts,systems,and laws,the author analyzes the family environment,social environment,and judicial factors.The last chapter,on the basis of the previous study,focuses on the design of the prevention and control path of domestic violence crime.Based on the judicial practice in the United States and the United Kingdom,first of all,the author will optimize early warning mechanism for crimes of domestic violence that are not yet committed,and implement them through legal channels and non-legal means.Secondly,in view of the completed or ongoing crimes,the author propose to improve domestic violence crime punishment mechanism,design criminal measures for crime and clarify conviction and sentencing for crimes of domestic violence.Finally,the author puts forward the construction of comprehensive social relief mechanism and fully mobilize all parties involved in the prevention and control of domestic violence crimes by constructing a comprehensive social assistance network and forming a long-term mechanism for prevention and control of domestic violence."Criminal prevention and control" does not specifically refer to crime control.It also covers crime prevention.In the field of criminology,crime prevention focuses on prior measures for offending crimes,while crime control focuses on post-punishment crimes.Whether it is the prevention of crimes in advance or the regulation of the crimes which have occurred,it is an effective means to curb domestic violence crimes.It requires the participation and cooperation of the government,the judiciary,public security agencies,and social organizations.Through the full participation of all parties involved,the prevention and control network of domestic violence crimes in China can be established and effective prevention and control of domestic violence crimes can be achieved.
