The confrontation between public power and private rights is an inevitable social contradiction in the rule of law society.On behalf of the power of public power,the exercise of the principal police,its defensive behavior or its actions to stop the crime often become the focus of public attention.The nature of police defense behavior has not been reached in academic circles.On the one hand,there is a view that the police force acting against the crime or the act of defending against it can be justified as a cause of obstruction.On the other hand,it is pointed out that police misconduct can cause abuse of public power,so that public power infringes on private rights.At the same time,several cases of private rights and public power conflicts have occurred in recent years,and the police defense research has become a hot topic again.In order to correctly assess the police defense behavior,it is clear that the exercise of force in the police defense process is permitted and which is excessive or inappropriate.This paper will study the nature of police defense and put forward the theory of the new dualistic theory of police defense,and analyze the type of police defense behavior.This will facilitate the definition of police defense behavior from the theoretical perspective and solve the confused confusion of police behavior in practice.On the one hand,the abuse of public power to prevent the improper infringement of the right of public power.On the other hand,it is also an affirmation of the reasonable behavior of the police,the recognition of the necessary military action,and prevent the police from pursuing the unjust prosecution after the implementation of the defensebehavior.
