Study On Some Problems Of The Crime Of Counterfeiting Currency

The currency is the most basic elements of a country's political,economic and social systems.All countries attach great importance to the protection of the distribution rights of their own currencies and the financial management order.Article170 of the criminal law of China stipulates: "whoever counterfeits money shall be sentenced to fixed-term imprisonment of not less than three years but not more than10 years and shall also be fined;Whoever commits any of the following circumstances shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment and shall also be fined or confiscated:(1)counterfeiting the ringleaders of the monetary group;(2)the amount of counterfeit money is particularly large;(3)other especially serious circumstances.Although the study of the crime of counterfeiting money is out of date,new problems are still emerging.It is necessary to study the difficult problems of the crime of counterfeiting money in order to ensure the stability and harmony of the society.In addition to the introduction and conclusion,this article contains the following four chapters:The first chapter is a specific analysis of the special criminal object in the crime of counterfeiting money.Firstly,which country's laws should be based on the judgment of foreign currency,and whether foreign currency,which can not be exchanged in our country but has the power of circulation,should be the crime object in the crime of counterfeiting money.Secondly,what kind of sample can be the object of a crime of counterfeiting money,and how to measure the sentence for the sample.Lastly,can the virtual currency be the object of the crime of counterfeiting money.The second chapter discusses the behavior of counterfeiting money.For example,whether counterfeiting money should be based on the existence of real money,to what extent will the forgery of money be achieved and the differences between forgery and change.The third chapter discusses the problem of determining the amount of the crime of counterfeiting money.Three cases are discussed.The first is the determination of the amount under different forms of crime.The second is the determination of the amount in the joint crime.The third is the determination of the amount of money entering the circulation.The fourth chapter is the determination of the number of crime of forgery of money.The discussion is divided into two cases.In the first case,the forged currency is exercised by the person who forged the currency.In the second case,the counterfeit currency is exercised by the person who does not forge the currency.The number of crime of counterfeiting money varies according to the different circumstances.
