China's cartoon animation industry has experienced more than 90 years of devel opment has gradually entered a stable period.And cartoon animation industry as a cor e of innovation for the development of the cultural industry has been the strong suppo rt of national policy.A large number of excellent cartoon anime works have received widespread attention,and have formed huge economic and commercial value.In the e conomic interests of the driven animated cartoon image infringement is also common occurance.And such infringement seriously damages the legitimate rights and interest s of right holder.Although animated cartoon image infringement issues have been con tinuously attention by our country in the national policy and judicial practice,the awa reness of enterprise rights is enhancing and the number of rights cases is increasing,a nimated cartoon image of the intellectual property legal protection is still not perfect,which can not meet the cartoon animation industry development requirements.In vie w of this,this paper analyzes the animated cartoon image copyright protection of the existing problems from the perspective of copyright,and put forward the specific mea sures.First of all,this paper researches on the basic concepts and related issues of anim ated cartoon image.This paper analyzes the basic problems of cartoon animation,and expounds the legal protection significance of animated cartoon image from three angl es: country,industry and right person.It also clarifies the development path of animat ed cartoon image.Secondly,this paper analyzes the advantage of animated cartoon image copyrigh t protection.This paper compares copyright with trademark rights,patent rights,antiunfair competition law and commercialization rights.It analyzes the protection mode,the theoretical basis and the protection standard of the copyright,and interprets the re lated cases of animated cartoon image copyright protection,so as to obtain the advant ages of copyright legal protection.Thirdly,this paper analyzes the shortcomings of animated cartoon image copyrig ht protection.It specifically includes the originality judgment criterion is vague,animated cartoon image has not become a class of independent works,it is difficult to iden tify the infringement and there are obstacles to copyright relief.Finally,the author puts forward the overall idea and concrete measures of perfect ing the legal protection of animated cartoon image.In the whole idea,it should adhere to enhance the original animated cartoon image of the original ability,develop anima ted cartoon image copyright protection development strategy and establish animated c artoon image copyright protection typical case guidance system.And In the specific measures,it should clear the original interpretation of the standard,define the type of independent works,solve the problem of infringement and improve the remedies of in fringement.
