The Present Situation And Improvement Suggestions Of Small Litigation In China

Since the last century,our country economy has developed rapidly,followed by a large number of small case disputes such as the economy gradually appear in People's Daily life,so the grass-roots court accepts the case quantity increase gradually,thus increasing the our country judicial pressure,at the same time our country original lawsuit system is not a quick fix to court accepting civil disputes,which affect our country's judicial efficiency,in order to save the judicial resources to improve the efficiency,grassroots courts are the judicial reform in the traditional lawsuit is proposed on the basis of a new type of simplified procedure,in order to achieve the case shunt effect.Our country started in 2012 formally established small lawsuit system,the system in certain circumstances to relieve the strain on the spontaneous provides a possible,but in the concrete judicial practice because the legal provisions of the regulations are not clear cause its not easy to operate,plus around inconsistencies,such as economy,policy,cause its not able to nationwide unified specification and application.Subsequently,China stipulated and divided small amount of litigation in the new civil procedure law in 2014,which provided a good foundation for the application of small amount of litigation.However,compared with other countries,there are still some problems.This paper studies as small as the research object of litigation in our country,put forward our country's present legislation characteristics and the application of small action advantage,then analyzing the other countries in the small lawsuit,and with XingNing city as the research object to analyze small lawsuit in the judicial practice in our country,thus put forward our country small introduction of the meaning of the litigation and existing problems,and put forward effective countermeasures to solve these problems.
