Comprehensive Reform Of Judicial System:Practice And Approach

At the 38 th session of the 18 th CPC Central Committee's Deep Reorganization held in August 2017,the meeting deliberated and adopted the Framework Opinion on Shanghai's Pilot Reform of Comprehensive Supporting System of Justice,and the comprehensive supporting reform of the judicial system with Shanghai as the pilot was launched.As the comprehensive reform of the judicial system is a complex project involving all aspects of the reform,it must follow certain principles and cannot be carried out aimlessly.It is necessary to formulate relevant systems and implement them,and it is necessary to explore breakthrough paths to make the work go forward in a solid way.Therefore,this paper expounds and analyzes the principles,systems and paths of the comprehensive reform of the judicial system.Apart from the introduction and conclusion,this paper is divided into three parts:The first part is an overview of the comprehensive reform of the judicial system.This part mainly focuses on the concept and characteristics of the comprehensive supporting reform of the judicial system,the background and necessity of the comprehensive supporting reform of the judicial system,and the principles of the comprehensive supporting reform of the judicial system.It also makes a detailed analysis on the principles of the comprehensive supporting reform of the judicial system,which are guided by Xi Jinping's new era of socialism with Chinese characteristics,adhere to the combination of top-level design and practical exploration,adhere to the systematic and comprehensive approach throughout the supporting reform of the judicial system,and adhere to the goal orientation of justice,efficiency,professionalism and authority.The second part is the practice of comprehensive reform of the judicial system.Based on the introduction of the current situation of the comprehensive supportingreform of the judicial system,this part diagnoses that the comprehensive supporting reform of the judicial system in our country still has the following problems: there are some conflicts between the administrative power and the judicial power,the administrative management of the hierarchical system still exists partially,the application of science and technology is not deepened,and the maintenance of judicial authority is not effective.The third part is the approach to the comprehensive reform of the judicial system.This part mainly puts forward solutions to the problems in the previous chapter,namely,it is suggested to standardize the power operation system by strengthening the allocation of judicial powers,strengthening the reform of internal institutions,strengthening the judicial performance evaluation,strengthening the supervision of law enforcement and judicial activities,and strengthening the power operation in other aspects.It is suggested to further improve the classified management system by strengthening post management,strengthening the recruitment,selection and training of judicial talents,promoting the separate job sequence management of judges and prosecutors,implementing the municipal unified management of human resources and property,and strengthening professional security.It is suggested to deepen the application of science and technology by strengthening the construction of judicial informatization and upgrading the modernization level of judicial auxiliary work.It is suggested that the judicial authority be effectively maintained by maintaining the finality of the judgment,improving the judicial execution,preventing improper public opinions from interfering with the judiciary,and protecting the safety and dignity of judicial personnel in performing their duties.
