As a new financial product,virtual currency has been rapidly developed and popularized,attracting more and more attention from different fields of society.At the same time,its trading activities have also risen in various countries,making it a trend to use virtual currency to buy online goods and services.Based on the characteristics of virtual currency,such as decentralized,anonymous and circulation depending on electronic data,it has the advantages of convenient access,it can optimize the allocation of resources,and effectively avoid financial risks,meanwhile,it has brought significant risks and shocks to the traditional financial field and the legal currency system.In order to deal with the risks in virtual currency transactions,countries have begun to explore this field actively,formulate relevant laws and policies,establish special institutions to strengthen supervision and guidance,and attach great importance to the supervision of virtual currencies.However,our country has just started in this respect.At present,China has a relatively negative attitude towards virtual currency,which not only closes down all domestic virtual currency trading platforms,but also denies the status and value of virtual currency in terms of laws and policies.However,as a new financial product,virtual currency's appearance is the historical inevitability,the negative attitude will only gradually widen the gap between China's financial developments with the rest of the world,what the country did can not fundamentally eliminate risks,and we should get to know and accept virtual currency through strengthening the supervision,promoting the development of it.Only in understanding the origin and developments of virtual currency,determining the legal attribute of the virtual currency,its issuance and trading and the risks of the problems existing in the current regulatory system,can we discuss how to carry on the effective regulation of virtual currency,how to innovate in regulation under the background of our country's financial status.So as to promote traditional economic transformation and development through newly sprouted things,provide convenience for the Internet economy booming and make full use of its advantages,and avoid the risks and crises which virtual currency could trigger.This paper expounds the emergence and development of virtual currency,analyzes the legal status of virtual currency and the prevention and control of current risks,then puts forward the prospect of the future development of virtual currency.The article mainly analyzes the regulatory status of virtual currency trading in our country,puts forward the problems existing in currentsupervision status and the causes of the problems mentioned,meanwhile,studies virtual currency trading supervision experiences and practice of other countries,discusses how urgently the need of virtual currency supervision is and put forward innovative supervision measures through the legislation,judicial and policy field.
