Research On The PPP(Public Private Partnership) Project Contract Dispute Resolution Mechanism

PPP mode,namely the cooperation mode between government and social capital,has been vigorously promoted by the state in recent years.It is conducive to improving the quality of infrastructure construction projects,improving public services and utilizing idle social capital.In the process of vigorously developing PPP model,there are some problems and disputes,such as the nature of PPP project contract and how to resolve disputes arising from PPP project.This reflects the shortcomings and needs to be improved in the aspects of PPP legislation and supporting dispute mechanism.In this paper,through case analysis,combined with the current development of PPP,PPP project contract dispute resolution mechanism is discussed.The problems and causes of qualitative PPP project contract and dispute resolution mechanism in China are found.Suggestions are put forward to solve the project contract and dispute resolution mechanism problem.In first part,it gives an overview and analysis of representative cases.Through the understanding of the cases,we can find the problems and conflicts,and abstract the common problems of the PPP contract dispute mechanism.In second part,I make a systematic analysis of problems of the PPP contract and dispute resolution mechanism.This involves the origin and development of PPP,the connotation of PPP,the nature of PPP project contract,PPP dispute resolution mechanism,etc.By the way,I also analysis similar cases in second part,introduces the corresponding situation of foreign countries for further understanding of the problem,and draws useful advice for the third part to solve PPP project contract dispute resolution in order to solve the problem of the PPP contract dispute resolution mechanism in third part.In third part,on the basis of the second part of legal analysis,I puts forward suggestions for solving the problems of PPP contract dispute resolution mechanism in China.
