Research On The Perfection Of Adult Guardianship Supervision System In China

With the aging of the world's population,the increasing number of people with disabilities and the innovation of the world's human rights concept,countries have adopted legal means to protect the legitimate rights and interests of the elderly and the disabled.The adult-oriented guardianship system has been produced and is quickly being Adopted by countries all over the world.At the same time,the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly also draws on the system and,through the promulgation of the General Principles of the Civil Law of the People's Republic of China,perfects the system of adulthood in China.However,with most countries in the world passing legislation and establishing a relatively perfect system of adult supervision and supervision,there is no perfect adult supervision and supervision system in mainland China,which can effectively protect the legitimate rights and interests of the elderly and the disabled.Based on the basic national conditions in which China has entered an aging society and a large number of disabled people,this paper aims to compare and analyze the domestic and foreign regulations on the key issues of the adult-oriented monitoring and supervision system on the basis of the systematic discussion of the adult-oriented monitoring and supervision system.It provides enlightenment and path for the improvement of the adult custodial supervision system in China,and better protects the legitimate r ights and interests of the elderly and the disabled.This paper consists of three parts: introduction,body and conclusion.The text can be divided into three parts.The first part is the definition of the main body of supervision in the supervision system.Through the historical analysis method combined with the relevant literatures of reading,the corresponding theories of the adult-oriented monitoring and supervision system are understood,and the concept definition,causes,historical evolution,establishment necessity and focus of the dispute are analyzed.Theoretically paving the way for the following explanations;The second part consists of the definition of the subject of the supervisory power exercise in the adult-oriented guardianship supervision,the supervisory power of the subject of the supervisory power exercise,and the supervision of the adult-oriented guardianship supervisor over the exercise of the supervisory power.Through the discussion of the above-mentioned focus issues,combined with the comparative analysis method,the author analyzes the similar ities and differences between the typical countries of the two major legal systems and the mainland China on the above-mentioned problems,thus providing enlightenment for the improvement of China's legislation;The third part is the perfect path of China's adult-oriented monitor ing and supervision system.According to the enlightenment generated by the comparison between the Chinese and foreign adulthood monitoring and supervis ion systems and China's national conditions,the problems existing in the adult-oriented monitor ing and supervision system after the promulgation of the General Princ iples of the Civil Law of the People's Republic of China are proposed,and a feasible and perfect path is proposed.
