As a comprehensive financial service on the base of financing through accounts receivable transferring,factoring has been spring up in recent years.However there is no comparatively perfect legal system to support the rapid development of factoring,which will increase the trading risk of the parties concerned and shackle the development of the factoring.This essay mainly analyzes a series of issues causing by the legal defects in the notice of accounts transferring.At the same time,the writer will show some ideas about how to solve these issues aboved.The whole article includes four parts.The first part briefly introduces the concept and classification of the factoring to make reader have a basic understanding about factoring.After setting forth the essence of the core of factoring—accounts transferring brings forward the most important part — related issue of the notice of accounts receivable transferring;the second part expounds the problems about the subject?content and time of notice in the cession of the obligatory right through introducing typical cases in the practice of factoring,the problems of the content and time of the notice are mainly for concealed factoring.The third part analyzes some preceding practices in the notice of accounts receivable and related legislation and judicial practice.This part briefly introduces how the local legislation and regulations in our country to solve the problems of factoring industry.The last part puts forward my own opinion about how to solve the issues in the notice system.
