A Study On The Necessity Of Censorship In China

In order to effectively safeguard the personal freedom and legitimate rights and interests of the criminal suspects and defendants,our country has set up the system of the necessity of custody after arrest.With the implementation of the relevant laws and regulations and the implementation of the relevant supporting mechanism,the necessity of post custody detention has achieved good results,and promote the construction of the rule of law society.However,as a new thing,there are a lot of imperfections in the system of the review of the necessity of detention,which has exposed many problems in the judicial practice.Therefore,it is an urgent and realistic problem to find out the problems,analyze the causes,and construct a reasonable procedure for the examination of the necessity of detention and improve the relevant supporting mechanisms.This paper intends to study the necessity of censorship in China through the following four parts:The first part is a brief review of the necessity of detention review system,including the purpose of the legislation,the applicable principles and functions,to lay the theoretical foundation for the development of this article.The second part is the status of the necessity of detention review system is elaborated,and in-depth analysis of causes of the system at the present stage and has made the following suggestions to follow.The third part mainly introduces the situation of the review of the necessity of extraterritorial detention,and summarizes the relevant advanced experience and the merits of each country.The fourth part is the author in China's current national conditions and judicial ecology,the necessity of detention review system to provide some shallow suggestions for improvement.
