Airspace is an important resource for national economic development and national defense construction,It is great significance to the social development of a country, and the limited land area determines the limited airspace resources. At present, the users of airspace are mainly concentrated in military aviation and civil aviation.Faced with the rapidly development of China~`s civil aviation industry and the increase in flight training of military aviation, both of them require more use of airspace.Due to factors such as the imperfect airspace legal system and unreasonable planning in China, the flight conflict between military aviation and civil aviation has gradually increased. Therefore,it is necessary to start from the perspective of the cooperation of airspace use by China`s military and civil aviation.Under the guidance of the military and civil aviation cooperation policy,we will reform the current airspace management system and establish a platform for military and civil aviation cooperation development by establishing a legal and regulatory system for airspace use,Multi-party participation in cooperation do a good job in the top-level design of airspace.By studying the regulatory of ICAO and developed countries in the use of airspace for military and civil aviation, combined with the reality of the cooperation of military and civil aviation development in China, there are planned and step-by-step innovations to propose the cooperation of military and civil aviation in China from the perspective of law.The legal system of development provides some insights into the future development of airspace management in China.Realize the maximum use of airspace resources by China`s military and civil aviation cooperation, and promote the common development of national defense construction and civil aviation economy.
