Atypical labor is a new form of employment that arises from the globalization of the economy.It is a change in the way of traditional employment.In the era of rapid rise of the sharing economy,atypical labor has become more and more important in the labor market,which cannot be ignored.Atypical labor relations are known for their flexibility,not only favored by the shared economic platform,but also become the choice of many labor providers.The rapid development of atypical labor relations in the era of sharing economy has changed the stereotype of traditional labor relations,it increased employment opportunities,while the crisis has also accompanied.Due to the lagging behind the recognition of traditional labor relations in China,and moreover in the sharing economy the typical labor relations has unfixed and unpredictable characteristics,many sharing economic platforms have alienated it as a tool to circumvent the law.In the judicial practice,there are also cases where the same case is different and the identification criteria are inconsistent.The atypical labor relations in the era of sharing economy are not only happening in China,but a global problem.From developed countries such as Europe,the United States and Japan to developing countries such as China,the impact of the atypical labor relations in the era of sharing economy has been presented to varying degrees.The atypical labor relations in the era of sharing economy are major challenge to labor law.Although we can see that the labor law has responded to this,these measures are far from the protection and regulation of labor providers and shared economic platforms.not enough.Therefore,it is extremely urgent to establish a set of effective long-term legal mechanisms.
