Research On The Existence And Abolition Of Death Penalty In China

Death penalty,a cruel punishment,has played an important role in a certain period of human history.With the development of social politics,economy and culture,as well as the wide spread of the humanitarian thought of international protection of human rights,people's concept of social justice is gradually changing.The role of death penalty in maintaining social order and protecting citizens' legitimate rights and interests is gradually decreasing,and its status in penalty is also declining.At present,many countries in the world have carried out major reforms on their own legal system of death penalty.More than half of the countries have completely abolished the legal system of death penalty,while the countries that retain the legal system of death penalty are also actively reducing the number or stopping the application of death penalty.In a sense,the social background of the existence of death penalty is changing quietly,and the abolition of death penalty has become the trend of the development of the international community.In other words,the abolition of death penalty will eventually be the inevitable result after the development of human society to a certain stage.Although the abolition of the death penalty has gradually become the trend of the development of the international community,scholars have a big debate on whether China should abolish the death penalty in accordance with the international development trend,has not yet reached a consensus.Through a comparative study of scholars' views on abolishing the death penalty and reserving the death penalty,the author believes that the abolishment of the death penalty should be considered from the perspective of long-term development,and the abolishment of the death penalty should be supported.In addition,by investigating the abolishment process of death penalty in foreign countries and combining with the actual situation in China,this paper analyzes the factors hindering the abolishment of death penalty in China and,on this basis,explores the path of abolishing death penalty in China.
