Study On Dong Biwu's Legal Thought In The Early Days Of The Founding Of New China

Dong Biwu is an outstanding Marxist,the proletarian revolutionary,the jurist and the founder of the legal system of our country.In the long-term leadership and administration,Dong Biwu has a unique view on the construction of the legal system,and has left precious wealth in the course of the construction of the legal system in China.This paper analyses the documents and historical materials of Dong Biwu's legal thought in the early days of the founding of New China,studies the conditions of Dong Biwu's legal thought formation in this period,and sums up the content of the legal thought.The theoretical value and practical enlightenment are obtained.In the early days of the founding of the people's Republic of China,Dong Biwu's legal system thought was the intellectual crystallization of Dong Biwu's combination of Marxist legal theory with Chinese revolution and construction practice,and was the theoretical summary of Dong Biwu's legal practice in this period.It has great theoretical and contemporary enlightenment.Not only enriched the treasure-house of Mao Zedong thought's legal theory,promoted the construction of democracy and legal system in the early stage of new China,but also "ruling by law" The important theoretical source of the General Strategy of the State of China.This paper is divided into four chapters: the first part is the introduction,which summarizes the purpose,significance and research methods of this paper,and briefly introduces the research status of Dong Biwu's legal thought at home and abroad.In the second part,the author analyzes the conditions of forming Dong Biwu's legal thought in the early stage of the founding of the people's Republic of China.The third part explains the basic content of Dong Biwu's legal thought in the early stage of the founding of New China,and discusses it from five aspects: legislation,judicature,law enforcement,law education and law abiding.The fourth part,combining the basic contents of Dong Biwu's legal thought in the early days of the founding of the people's Republic of China and the current situation of the construction of the rule of law in China,discusses the theoretical value and practical enlightenment of Dong Biwu's legal thought.
