Study On The Improvement Of Penalty Allocation Of Environmental Crime In China

The increasing destruction of the ecological environment in China reveals that the task of environmental protection is arduous,and the inadequate protection of the ecological environment is caused by many reasons.One of the important reasons is that the criminal law,as the last barrier,fails to give full play to its role as a safeguard law.Therefore,it is particularly important to innovate the system of environmental crime.As a key link of this system,the allocation of penalties should be adjusted with the development of the times,so as to better prevent and combat environmental crime.Therefore,it is particularly important to innovate the system of environmental crime.This paper starts from the criminal legislation and criminal justice of environmental crime,analyzes the existing problems of the allocation of environmental crime penalty,and puts forward its own suggestions for improvement on this basis.This paper is divided into three parts: introduction,text,conclusion and prospect.In the introduction part,the author introduces the research background,significance and purpose of environmental crime.In the conclusion and outlook section,author briefly reviews the research content,demonstration process and research deficiencies of the whole article.The text mainly includes three parts: The first part is an overview of environmental crime and its penalty allocation in China.In this part,the author summarizes several mainstream opinions on the concept of environmental crime in current academic circles,analyses the characteristics of environmental crime which are different from traditional crime,and combs the legislative evolution,legislative concept and the characteristics and functions of the types of penalty allocation of environmental crime,which lays a foundation for the later research and analysis.The second part is the current situation and existing problems of environmental crime in China.In this chapter,the author starts with the legislative and judicial status of the penalty allocation of environmental crime,and analyses the shortcomings of the current penalty allocation of environmental crime.The third part is the suggestion of perfecting the penalty allocation of environmental crime in our country.In view of the characteristics of environmental crime and the problems analyzed according to the current criminal situation,the author puts forward corresponding suggestions for improvement in order to better control environmental crime and protect our ecological environment.
