Research On Testamentary Trust System

In the modern sense,the probate trust system should originate from Britain in the 13 th century,which is the concrete embodiment of the English usufruct system.The probate trust system is an old system,but in practice,it constantly glows with new luster and vitality,and has been widely used in many countries outside the region.Testamentary trust system is to improve and perfect,in Anglo-American countries testamentary trust system in China starts late,however,with the deepening of China's reform and opening up,the constant innovation of science and technology,economic level unceasing enhancement,constantly enrich people's material wealth and property in the form of increasingly diverse,makes the testamentary trust this heritage approach of increasing demand.Inheritance law relations become increasingly complex in our country,the estate of our country related laws put forward higher request,the testamentary trust system as heritage processing one of the important system even more so,however,only the testamentary trust system in our country has carried on the simple rules,roughly in the inheritance law of the People's Republic of China(hereinafter referred to as "inheritance law")almost no relevant provisions in the,difficult to meet the needs of the complex reality in our country,therefore,at present to conduct the thorough research to the testamentary trust system in China is urgent and necessary.Based on this,this paper firstly defines the concept and connotation of testamentary trust,and clarifies the concept of testamentary trust and related concepts.On the basis of clear concept,the author makes a detailed introduction and analysis of the system value and function of testamentary trust.Testamentary trust has important functions and functions,which requires us to improve our country's testamentary trust system to maximize its system value.To this end,the author on the outside on behalf of the state of the testamentary trust system are studied,in order to seek empirical enlightenment for our country,on this basis,the author of the existing problems of testamentary trust system in China are analyzed in detail and explore,combining with the experience of advanced outside to put forward some Suggestions and comments,so as to perfect the construction of the testamentary trust system in our country to provide more choice.
