With the aim of perfecting national system of the removal of wrecks and solving the problems existing in China's legislation and practice e this paper studies the issues related to the geographical scope of the Nairobi International Convention on the Removal of Wrecks in China.On the basis of summarizing the discussion on the formation of the scope of the Convention's geographical scope and the views of domestic scholars,this paper analyzes the problems existing in legislation and practice,and studies the necessity and possible influence of expanding the geographical scope of the Convention in China.It draws.the conclusion that the geographical scope of the Convention should be expanded in China,and gives recommendations on the countermeasures when the Convention expands its geographical scope.This article is divided into four main chapters.The first chapter summarizes the discussions on the geographical scope of the Convention by representatives from various countries and industries during the formulation process.It summarizes the process of domestic scholars studying whether to join the convention and how the convention applies in China.The chapter also provides a summary and analysis of China's current selection of the scope of application of the Convention in China and the series of measures adopted by China to implement the relevant provisions of the Convention.The second chapter analyzes the current situation of the domestic wreck removal system and the possible drawbacks of the two wreck removal systems existing at the same time.It concludes that the disadvantages are large if the convention can only be applied to China's exclusive economic zone,and it is necessary to expand the geographical scope of the Convention in our country.The third chapter focuses on the analysis of the possible impacts of expanding the scope of the Convention's geographical application in China,including the possible impact on national sovereignty,domestic regulations and relevant stakeliolders.After analysis,it is concluded that the expansion is positive on the whole.The fourth chapter analyzes the measures to expand the scope of the Convention's geographical application in China after studying the domestication practice of similar international conventions in China.After that,this chapter concludes the problems and concerns that may arise in expanding the Convention's geographical application in China which may exist in notifying the Secretary-General of the International Maritime Organization,declaring the new scope of application of the Convention in China,amending and improving existing domestic regulations,and refining the relevant provisions of the Convention.
