A Study On The Causes Of Entities And Procedures With Low Parole Application In China

Parole,as an important penalty execution system in China,plays a very important role in maintaining the stability of the prison,mobilizing the enthusiasm of criminals to reform,and making a law-abiding citizen for criminals to return to the society smoothly.However,in practice,there is a low rate of parole application,and prison police dare not apply parole.Based on the author's experience in prison practice,this paper explores the causes of the low application rate of parole.The thesis is divided into four parts.The first part briefly explains the concept,nature and function of parole,and expounds the essence and connotation of parole system;the second part analyzes the current situation of low parole application rate in China through the comparison of parole application rate between China and foreign countries and between commutation and parole application rate in China,and then summarizes some advantages of parole system;the third part explores the reasons for low parole application rate in China from entity and process In order to find out the problem of low application rate of parole in China,the fourth part mainly puts forward suggestions and suggestions on improving the application rate of parole in China from four aspects,such as changing the concept of execution and improving the evaluation mechanism of criminals' recidivism,so as to provide some references for the full application of parole in practice.
