Research On The Performance Evaluation Of Chinese Procurators Against The Background Of Judicial Reform

The examination and evaluation of procuratorial work is a standard system to evaluate and guide theprocuratorate business work.It is not only the constitutional requirement of the integration of procuratorial system,but also one of the important means to promote the effective implementation of procuratorial power.Especially in the context of trial-centered criminal litigation system reform,judicial system reform,and supervision system reform.The post system reform,the judicial responsibility system reform,and the reform of the internal institutions have been superimposed.The past business evaluation mechanism has no longer adapted to the actual situation of the current procuratorial organs.This paper analyzes the business evaluation system of procuratorial organs from the perspective of S province,studies the existing problems of procuratorial business evaluation in practice through empirical investigation,and puts forward some reform and improvement suggestions based on some new situations in judicial reform.In addition to the introduction and conclusion,the full text is divided into four chapters todiscuss,as follows:The first chapter mainly discusses the concept,course andsignificance of the evaluation mechanism of procuratorial business.The procuratorial business evaluation mechanism discussed in this paper only refers to the mechanism of the provincial procuratorate's overall evaluation of the procuratorial organs based on the core data of the procuratorial business and the quality assessment of the case.From the embryonic form,development to maturity of the three stages of development,we can find that the operation of the procuratorial businessevaluation mechanism is based on the integrated procuratorial system,administrativemanagement mechanism and the regulation and control of the operation of procuratorialpower.Judicial practice has proved that the procuratorial business evaluation mechanismis of great significance to implement the principles and policies of higher procuratorialorgans,promote the active operationof procuratorial power,andimprove the professional quality and ability of procuratorial teams.The second chapter summarizes the current situation of procuratorialbusiness evaluation mechanism.Taking the annual evaluation of the municipal procuratorate by the S provincial procuratorate as an example,its overall frameworkmaintains four parts:the examination of procuratorial business,the evaluation of thereport of the chief procurator of the municipal court,the public opinion survey and thecomprehensive increase or decrease of points.The examination of procuratorialbusiness mainly includes the core data of procuratorial business and the evaluation ofcase quality.The core data scoring method of procuratorial business is to implement thefull score benchmark scoring method on the basis of the per capita number of casesand to further quantify the evaluation indicators and the case quality evaluation directlyadopts the score reduction system.How to apply the evaluation results.The third chapter discusses the problems existing inthe operation of procuratorial business evaluation mechanism.Firstly,themain body of the evaluation is too scattered;Secondly,the core data project issues are prominent,mainly due to the low proportion of core data in the assessment,too many projects,unreasonable scoring methods,etc.;Thirdly,the connection of the evaluationindexes of different business departments in the aspects of task allocation,evaluationmode,weight score and so on is not scientific enough;Fourthly,the quality orientation inthe case quality evaluation is not prominent.The fourth chapter discusses the necessity and concreteimprovementmeasures of the reform of procuratorial business evaluation system.As a result of the inadaptability between the current procuratorial business evaluation mechanism and the reform ofsupervision system,judicial responsibility system and internal organization is becoming more and moreprominent.Combined with the working practice,the author puts forward the following suggestions:The first is to adapt to the new requirements of the procuratorial organ's function adjustment and internal institution reform,and the case management department will be responsible for the overall business evaluation work;The second is to improve the scientification of the procuratorial business evaluation index system.The third is to improve the refinement ofprocuratorial business evaluation index system;The fourth is to promote the quality and efficiency of case qualityevaluation;The fifth is to improve the personal performance evaluation mechanism of post prosecutors.
