On The Acquisition And Application Of Extraterritorial Evidence Of Terrorist Crimes

As China's globalization process has gradually entered the deep water zone,international political and economic exchanges have become increasingly close,and cultural exchanges have become increasingly diversified.This change has also led to an increase in the number and complexity of transnational crimes in the field of criminal crimes,especially terrorist crimes.With the development of terrorist organizations in the Middle East becoming increasingly large-scale and systematic,terrorists have become more systematic and covert in early preparation and personnel training,and their criminal behaviors are no longer limited to one country or one place,but show a trend of cross-border flow.This requires the judicial organs to not only conduct cross-border cooperation in the investigation and collection of evidence,but also examine and apply extraterritorial evidence in the litigation stage,which is also an important means to combat terrorist crimes.In this paper,to explore,on the basis of existing domestic laws and regulations,international conventions,the terrorism crime evidence gathering outside of our practice,combining with the particularity of international terrorism crime evidence review,in-depth analysis of extraterritorial evidence for the fight against terrorism crime and the applicable rules and requirements,in view of the domestic existing research limitations and related legal mechanism lag,through the analysis of foreign terrorism crime on outside forensics and system,and provide theoretical and practical reference for this study.Chapter one,from the perspective of judicial status,the particularity of extraterritorial crime evidence,international law and other perspectives,summarizes the current situation of extraterritorial evidence acquisition of terrorist crimes and the application of law;The second chapter focuses on the analysis and introduction of the relevant systems of western countries to deal with the extraterritorial evidence of terrorist crimes and forms the experience inspiration.Chapter three,based on the difficulties of extraterritorial evidence collection,analyzes the influence of evidence sources on the application of evidence collection;The fourth chapter,based on the above chapters,puts forward the establishment of the extraterritorial evidence acquisition path applicable to the fight against terrorist crimes in China,divides the extraterritorial evidence types,clarifies the examination thoughts of extraterritorial evidence,and determines the examination methods of extraterritorial evidence,aiming at promoting the perfection and development of the extraterritorial evidence examination and application system of terrorist crimes in China.
