Study On The Legal Regulation Of "Affiliated" In China's Construction Projects

The problem of building project attachment has existed for a long time in the construction field of our country.It is a long-standing problem in the construction market.The phenomena of building project attachment and illegal subcontracting,illegal subcontracting and so on have a notable destructive effect on the order of the construction market,which can be called endless aftermath.The affiliation of the construction industry refers to the act of undertaking construction projects in the name of other construction enterprises or individuals with corresponding construction qualifications or higher qualifications for the purpose of obtaining economic benefits.Linking to the construction market has caused a great impact on the healthy development and stability of order,and also buries the hidden danger of unsafe for engineering quality and construction safety,it is easy to produce engineering accidents and endangering the safety of people's lives and propertyTherefore,this paper firstly analyzes the affiliated operation of construction market,discusses the origin and present situation,legal definition,legal characteristics and manifestations of affiliated operation,and on this basis,proceeds from the unique market access system of construction market and the drive of economic interests,analyzes the affiliated operation in depth.The harm to the phenomenon of affiliation is mainly reflected in three aspects:disturbing the order of the construction market,breeding corruption and the risk of tax loss,and finally leading to endless legal disputes.At present,there are some deficiencies in legislation,law enforcement,judicature,law-abiding and social supervision in the legal regulation of building project attachment.In order to improve the deficiencies in the legal regulation of building project attachment,the last part of this paper puts forward some suggestions from five aspects:legislation,law enforcement,judicature,law-abiding and social supervision.It is expected that an all-round legal regulation system will be formed for illegal affiliation,which will play a role of promotion and protection.
