Construction Of China-EU Investment Dispute Settlement Mechanism Under "The Belt And Road" Initiative

As the global economy continues to slump,regional agreements with different demands have sprung up,and the trend of "reverse globalization" has arisen,and economic globalization faces challenges.In this context,"The Belt and Road" initiative is a major strategy for China to actively face the deployment of complex multilateral international political and economic situations,to create large-scale and deep-level regional cooperation,and to build a communi of human destiny.The promotion of this initiative,benefiting Global,contains unlimited business opportunities and will face unprecedented challenges.It needs to be jointly built by countries along the "Belt and Road".In mid-September 2018,the European Commission published a policy document entitled "Connecting Europe and Asia-Imagination of the EU Strategy".Its strategic blueprint views China as a development focus,indicating that China and the EU will be in the near future.Conduct in-depth cooperation in many fields.The frequent exchanges between China and the EU also indicate that investment disputes will continue to emerge.At present,the settlement of investment disputes between China and EU member states is complicated,and the lack of a unified and effective investment dispute resolution mechanism is a worry for international investment between China and Europe.In order to promote "The Belt and Road" initiative,the establishment of the China-EU investment dispute settlement mechanism has become the most pressing issue.The China-EU investment dispute settlement mechanism aims at solving the investment dispute settlement between China and the EU based on the background of "The Belt and Road" initiative and taking full account of the predicament and development trend of the investment dispute settlement.The mechanism will not only serve as a platform for resolving investment disputes between China and the EU,but will also provide experience for the future construction of regional investment dispute settlement mechanism.This paper starts with an analysis of the settlement of investment disputes between China and EU member states and the settlement of practical practices.It aims to strengthen the operational difficulties of China-European investment dispute settlement mechanism,lack of corrective mechanism,fairness and independence.Strive to build a regional dispute settlement system and accelerate the construction of the community of human destiny.Based on the current CPTPP agreement and the reform system CETA and TTIP agreements,we will understand the frontiers of the reform of the investment dispute settlement mechanism and try to invest in the court.The system is the core to build the China-EU investment dispute settlement mechanism,and further proposes suggestions and ideas for constructing a sound China-EU investment dispute settlement mechanism from the three aspects of construction principles,construction paths and construction measures.
