Research On The Legal Regulation Of School Bullying

Bullying on campus seriously threatens the school's teaching order and the legitimate rights and interests of students,and brings enormously negative impact on social development,which has aroused widespread concern of our whole society.In response,China has adopted a series of measures in terms of laws and regulations,and issued a number of regulatory documents to prevent bullying in schools.For example,in December 2017,eleven departments including the Ministry of Education jointly issued the "Strengthening Comprehensive Management Plan for Primary and Secondary School Student Bullying";The "Minor Protection Law" was amended in October 2019,and for the first time,the content of prevention and control of school bullying was written into the law.Nonetheless,there are still many problems in the legal regulation of school bullying in China.Therefore,it is of great value and significance to improve the laws and regulations of prevention school bullying,based on the current status of the legal regulation of school bullying in China,and to learn from foreign theories and legislation.The text is divided into the following four parts:The first part is a brief introduction of the content of bullying on campus.Firstly,the boundary between the two concepts of "school bullying" and "school violence"was clarified;Secondly,the definition of school bullying in China and other countries and regions was systematically sorted out,and the definition of school bullying was redefined;Finally,based on above,analysis of the classification and characteristics of school bullying.The second part is to analyze the current situation and causes of bullying in campus.The current status mainly includes four aspects:frequent occurrence of bullying on campus,constantly changing of bullying implementer,crueler means,and neglect of the bullying phenomenon by families and schools.The causes of school bullying can come from many factors such as student,family,school and society.The third part focuses on the existing problems in the legal regulation of school bullying.The current problems in China mainly include the following four aspects:the lack of specialized legal norms for the prevention and control of school bullying,the criminal legal system's problems in regulating school bullying have become more prominent,the defects of the minors' correction system have become more apparent,and inadequate application of some administrative laws and regulations has weakened the protection of minors.The fourth part,on the basis of the previous analysis,puts forward corresponding suggestions for the improvement of school bullying laws and regulations in China.Specifically,it includes the formulation of a special"Anti-School Bullying Law" to perfect and detail measures for the prevention and treatment of school bullying;adding the " Principle of Malicious Supply Age " to further improve the role of the criminal legal system in combating vicious school bullying;and gradually reforming the system of detaining for reeducation and work-based education to strengthen the education and correction of minors,and strengthening the application of relevant administrative laws and regulations to eliminate the source of minors' bad thought.
