With the development trend of online entertainment dominated by traffic,the imbalance of online economic development is increasingly prominent.The individualization and virtualization brought by online products cannot meet the real needs of the public in the current fast pace.People have a stronger demand for entertainment that combine real social communication with stress relief.The transformation and upgrading of offline entertainment industry has become an inevitable trend of high-quality economic development.Realistic scene games are emerging industries that are booming under this situation.Relying on the rise of the concept of "immersive experience",the real scene games introduce new technologies on the original basis,enriching the game content while enhancing the sense of interactive experience,and paying more attention to the unique sense of immersion brought by the original.Nowadays,the focus on games in the legal field is more concentrated on online games,and even the narrowing of games is defined as online games,resulting in the increasing originality of the real scene game copyright has not been given more attention.As a new type of work,realistic scene games are in a gray area due to the blank of legislation,and it is not sure whether they can be protected as objects under the copyright law.Therefore,when it comes to infringement,the judge can only separate the game elements to protect,cannot judge the overall substantive similarity,also cannot protect the real scene of the game as a whole originality.No matter the game elements or the whole game,based on the complex characteristics of the realistic scene game as a cross-media comprehensive work,there is no unified regulation on ownership and rights use transaction in accordance with the requirements of the copyright law,so it is difficult to protect the legitimate rights and interests of the copyright owner.At the same time,the convenience and cheapness of resource acquisition give the plagiarists more space,and the offline business mode is affected by human factors.There are difficulties in obtaining evidence,the amount of compensation is limited and so on when infringing,which cannot play an effective warning role.All of those are bring great difficulties to the copyright protection of real scene games.The attributes of the work are unclear,the type of copyright infringement is complex,and the judicial mechanism of copyright is not perfect.These situations are the dilemmas faced by the research on the copyright of realistic scene games,which is not conducive to protecting the creative environment of realistic scene games.Originality is the key to the core competitiveness of realistic scene games.In the judicial practice,there is basically no case of infringement of the realistic scene games,so that the relevant issues of copyright are not paid enough attention and have little influence.However,the actual phenomenon of peer plagiarism in reality is a problem that creators worry about.We cannot wait for the problem to expand before we solve it,but we should plan ahead.At this stage,it is in the critical period for the development of realistic scene games.Paying attention to the copyright issues is conducive to protecting the intellectual achievements of creators,stimulating the industry innovation awareness,and training professional design talents,so as to form a high-quality and rapid industry development mode.Therefore,it is necessary to study copyright issues in realistic scene games.To analyze the dilemma faced by the research on the copyright of realistic scene games,firstly,defining the nature of the works of realistic scene games from a theoretical level and clarify the legal status that they can be protected by copyright.Secondly,analyzing the nature and reasonable using scope of the realistic scene games copyright infringement from the perspective of typology,clarifying the boundary of the copyright infringement,and guides the realistic scene game practitioners to use others' works legally and reasonably.Finally,on the basis of the analysis of legal basis,it is necessary to improve the judicial mechanism of copyright in realistic scene games,which can be improved through the implementation of copyright case guidance system,the promotion of joint rights protection system of individual cases,and the innovation of tort rules system.
