Research On The Legal System Of Pledge Of Accounts Receivable

The demand for financing makes the need to expand the scope of collateral very strong,and a large number of accounts receivable formed in modern economic transactions.Due to the lack of monetary liquidity and realization speed of accounts receivable,it accounts for a large proportion of the resources of enterprises,but it can not be well utilized.In order to obtain financing support,there has been a large number of financing pledged by accounts receivable.The property Law was promulgated in 2007,which is the first time that the effectiveness of the pledge system of accounts receivable has been determined in the legal system,which provides a new financing way for many enterprises in our country.This is not only conducive to solving the current financing difficulties of the majority of enterprises,but also conducive to promoting the improvement of China's financial financing system and good economic development.The provisions of the laws and regulations related to the pledge of accounts receivable in the property Law and the measures for the Administration of Pledge Registration of accounts Receivable are not detailed enough,which leads to a lot of confusion in practice and restricts the function of the pledge system of accounts receivable.By combing the pledge system of accounts receivable and conducting an empirical study on 5080 judgment documents,this paper analyzes the specific functions of the pledge system of accounts receivable in practice and the deficiencies exposed in the system,and puts forward some targeted suggestions in view of the deficiencies.I hope to provide a new idea for the theoretical innovation and practical application of the pledge system of accounts receivable in our country.In addition to the summary,thanks and conclusion,this paper consists of five chapters.The main content of the first chapter is an overview of the pledge guarantee system of accounts receivable in our country.The author mainly introduces the legal concept and characteristics of accounts receivable,the realistic background of promulgation and the legislative process of accounts receivable pledge in our country,as well as the realistic legislative needs of our country and the pledge registrationsystem of accounts receivable in our country.The pledge registration system mainly introduces the specific process of its registration,the scope of pledge registration,the types of registration and the effectiveness of registration,the security of the system and the specific operating system.The second chapter is about the legal system of pledge of accounts receivable in typical countries in the world.Through the introduction of the concept and legal characteristics of the pledge registration system of accounts receivable in the United Kingdom and the United States,it is hoped that it will be helpful to improve the pledge system of accounts receivable in our country.The third chapter is from the perspective of empirical research,analyzes the situation of chattel financing in recent years,makes an empirical analysis of 5080 samples of judicial documents,and obtains the research results of many problems in the practice of the pledge system of accounts receivable in our country.and use pie chart,line chart to show the research results,such as unclear definition of accounts receivable,lack of effective way to realize the right of priority of pledge,and so on.Finally,the article puts forward some suggestions for the deficiency of the pledge guarantee system of accounts receivable in our country,such as the concept is not perfect,the pledge registration system is not perfect,the realization way of accounts receivable is not clear and so on.
