With the rapid development of the mobile Internet and the continuous updating of smart phones,we have been inseparable from various APP software when using mobile phones.While providing convenience for our lives,the APP also exposed many problems in the process of collecting user personal information.The economic value of personal information enters people's eyes and becomes a lure of interest.There are many specific problems when APP collects personal information,such as the way and purpose of uncollected collection,the difficulty in understanding the format terms,the excessive collection of user information,and the improper use of the collected information.Taking effective restraints on the collection of personal information by all parties to the APP is conducive to promoting the healthy and orderly development of the industry and enhancing the security of the collection,storage and use of personal informationLooking at the current laws,the protection of personal information is relatively incomplete.We can draw on the legislative experience of the European Union's General Data Protection Regulations and learn from the director's use of our personal information protection legislation.In response to the problem of APP collecting personal information,how to use legal means to regulate is the focus of our research.First of all,at the legislative level,consideration can be given to setting up protection of personal information rights for emerging rights.Criminal law charges should also be more complete and rich to meet the needs of different situations.Speed up the legislative process of the Personal Information Protection Law.At the judicial level,the improvement of the burden of proof and the improvement of the public interest litigation system will help promote the implementation of the personal information protection system.In view of the situation th at the platform supervision is not fully implemented,relevant industry and information technology departments should improve the administrative supervision ability,promote the APP platform itself to form an orderly and healthy industry development environment,and introduce the internationally recognized privacy risk assessment mechanism.Mobilize all forces to regulate the collection and use of personal information by APP,so as to escort the orderly development of personal information in the era of big data.
