Research On International Criminal Judicial Assistance Of Transnational Network Crime

With the rapid development of the Internet,people have a fast life,but also spawned a variety of new forms of crime different from the traditional crime.According to some data,the number of traditional violent crimes and property crimes in China is gradually decreasing,and the number of crimes involving telecommunications,Internet and other media is increasing.The problem of cyber crime is a hot issue in today's society.International organizations such as the European Union,the League of Arab States,the African Union,the United States,Canada,Japan and other countries have a lot of legal practice,and the research on Transnational cyber crime is also in-depth.But at present,the basic theory of network crime has not been unified,so there are many frictions and controversies in the international criminal judicial assistance for this kind of crime,which has profound research significance.First of all,this paper systematically expounds the development,origin and characteristics of transnational cybercrime and international criminal judicial assistance,and then summarizes the concept of transnational cybercrime by citing the main points of view of cybercrime.Secondly,by introducing the international treaties made by the major international organizations and the domestic legislation of some representative countries,it reflects the international attention to transnational cybercrime,and provides reference for the suggestions put forward later.In addition,the article lists the main problems of criminal judicial assistance for transnational cybercrime.In the end,some suggestions are put forward.
