The Study Of The Apostolic Nuncio's Diplomatic Privileges And Immunities

The apostolic nuncio is really unique in the International community.Compared with the ambassador,they are not only entitled to the right of diplomatic privileges and immunities provided by international law,but also assume the responsibility of safeguarding the authority of the Pope and the interests of the Vatican in the relationship between political-religion.However,Chinese scholars'research on the subjects of diplomatic privileges and immunities is mostly concentrated in the scope of heads of state,international organizations and diplomatic ambassadors,and relatively little attention is paid to the apostolic nuncio.In fact,The apostolic nuncio,as the representative of the Pope,is an important bond for the Vatican to maintain the unity of the Catholic church in the international community.In addition,the study on the diplomatic privileges and immunities of the apostolic nuncio in theory can also provide some references to solve the problem of the normalization of Sino-Vatican relations in future.The introduction mainly discusses the theoretical value and significance of diplomatic privileges and immunities of the apostolic nuncio,and points out the main purpose of this paper.The paper is divided into three chapters.The first chapter is an overview of The apostolic nuncio.In the first part,the concept of the Vatican and the Vatican city state is analyzed to understand the historical background of the Vatican and the origin of the apostolic nuncio.Second,define the concept of The apostolic nuncio and its main tasks and responsibilities in the Vatican.Finally,the characteristics of the diplomatic activities of the apostolic nuncio are analyzed from the perspectives of subject,content and method.The second part points out the basis of the existence of the apostolic nuncio from three aspects:history,law and theory,which is to prove the rationality and significance of the diplomatic activities of the apostolic nuncio.The second chapter is about the content of the apostolic nuncio's diplomatic privileges and immunities.Discuss the privileges and immunities of the apostolic nuncio in diplomatic activities from six parts:inviolability,jurisdictional immunity,freedom of communication,freedom of movement,tax exemption,customs duties,baggage exemption,the diplomatic corps and the apostolic nuncio's diplomatic privileges and immunities,and the different from the ambassador.The third chapter is the application of the apostolic nuncio's diplomatic privileges and immunities in China.Firstly,the relationship between the early China and the Vatican was discussed.The earliest contact between the two sides occurred in the Yuan Dynasty.Secondly,in the period of the Republic of China,it's a difficult road of establishing diplomatic relations between China and the Vatican.Finally,it's a brief analysis of the possible application of the apostolic nuncio's diplomatic privileges and immunities to China after the normalization of Sino-Vatican relations in the future.The conclusion part mainly points out that when applying diplomatic privileges and immunities,the apostolic nuncio also need to respect the sovereignty of recipient country over religious matters,instead of interfering in the internal affairs of recipient country based on religious freedom,in order to promote bilateral relationship between the two sides.
