| Protecting the integrity of the work is an important personal right of the work.The copyright laws of most countries in the world stipulate this right.The Berne Convention,which has a profound impact on the world’s intellectual property,can also find detailed provisions on the protection of the complete right of works.However,the provisions of China’s Copyright Law on protecting the integrity of works are relatively simple and general,so that in practice,infringement cases concerning the protection of the integrity of works often do not have a unified standard for determination,and different judgments in the same case often occur.Discussing the protection of the complete right of works,you can seek a more reasonable system design and improve the relevant legal system in China.In addition to the introduction and conclusion,the text is divided into five chapters.The contents are as follows:The first chapter summarizes the origin and development of the protection of the integrity of the work,and compares the development trend of the right in the civil law system and the Anglo-American law system.Chapter 2 establishes the legitimacy of protecting the integrity of works.From the three perspectives of human rights value,will freedom and cultural value,the value and function of protecting the integrity of works are explained;protecting the integrity of works is to protect culture and can directly promote the inheritance and development of culture.The third chapter combines the relevant concepts and knowledge,comparatively analyzes the differences and similarities between the protection of the complete right of the work,the right of modification and the right of adaptation,and discusses the rights of each of the three rights.Starting from the actual case,the fourth chapter first proposes two standards for infringing on the protection of the integrity of the work,that is,the standard of detrimental works and the reputation of the author,and analyzes the advantages and disadvantages of the two standards.At the same time,it discusses the determination of substantive changes and distortions and tampering,and clarifies the rules for determining the infringement of the right to protect the integrity of works.Chapter 5 supplements the restrictions on protecting the integrity of works.Reasonably grasp the restriction of rights and clearly define the principle of"necessary changes" to protect the rights and interests of the users of the works;setting restrictions on the protection of the complete rights of works is actually conducive to the standardization of the entire cultural industry. |
