Research On Legal Issues Of Plant New Variety Protection Based On Planters' Rights

China is a country with abundant plant genetic resources.But developed countries started to protect new plant varieties earlier,so the number of new plant varieties protected by rights abroad is increasing,which will inevitably cause China's agricultural market to be controlled by people.If we don't pay more attention to the protection of new plant varieties,it will inevitably lead to the serious consequences of our agricultural market being occupied by foreign companies.Therefore,it is necessary to establish a new plant variety protection system suitable for China's national conditions.Of course,China is also a large agricultural country and growers also occupy a large base in agricultural production,so protecting their rights and interests is the most important.Due to the different national conditions of western countries and China,they are more inclined to protect the rights and interests of breeders in the protection of new plant varieties.Therefore,how to combine with the actual situation in China under the premise of conforming to the international trend,and taking into account the production interests of growers while protecting the rights of breeders;how to prevent the loss of plant genetic resources in China when the variety of new plant variety protection continues to expand;how to better construct a new plant variety protection system based on the rights of growers is the main content of this study.At the same time,by comparing the inherent relationship between variety right and growers' right,this paper expounds the current situation of the protection of new plant varieties in China,and puts forward reasonable and feasible suggestions for the corresponding legal system in China,combining with the actual legislative situation of other typical countries,with a view to protecting new plant varieties and better realizing the rights of growers.
